Default For People Injured While on Medical Tourism in Germany

I know that many people read forums for information, feedback about doctors, hospitals, procedures etc.
Most of those people dont post but they are all out there trying to educate themselves, trying to make the best choice possible. Sometimes those choices turn out into a non ending lifetime nightmare.

The information in this post might help those who was injured in Germany while on medical tourism.

There are organizations in Germany that suppose to look after surgeons/doctors to ensure that people are not being harmed. In my limited knowledge, different parts of Germany have different organizations that overlook the above.

How I learned it: When I was in Germany, I had a pastor visiting me (I was lying in bed after my Prodisc-L implantation) and he told me that in Germany, the injured person who doesnt want to deal with court or dont have money, can use one of those organizations for an evaluation of what one thinks was incorrectly done. The evaluation is for free and its kind of part of the set up system, to make sure that people can address or simply evaluate their devastating experiences with doctors or clinics by independent professionals.

The injured in Germany person can send them (by mail) a detailed complaint and medical data with copies of reports, MRIs etc.; statements from other doctors regarding the issue etc.; and ask for an evaluation of the case. I think English is OK. Its absolutely free but it doesnt guarantee that they will look at it (if you are not a German resident), or that a doctor(s) chosen for the evaluation will not be biased in one way or another. It might take one year or more. But for some people, it might be the only hope in order to understand what took place.

For Bavarian Region the organization name is: "Gutachterstelle für Arzthaftungsfragen bie der Bayerischen Landesärztekammer" (BLÄK) (Bavarian national physician chamber).

This does sound like a good resource for many folks. However, if they have experience physical ailments that inhibit mobility which was not present prior to surgery, or other aliments post-op that were not present before, then this one-year time period could grossly affect their rights to file arbitration or file suit in Germany, since the statue of limitations changed following reunification. I would highly recommend to everyone considering surgery, especially in Germany, to request a copy of the service contract and arbitration agreement for review prior to traveling there. It would be a greater benefit to have a qualified attorney review these documents prior to traveling to Germany for surgery.

I would recommend seeking competent legal advice from a qualified international law attorney.
